NISSAN OF BOERNE ONE TO ONE REWARDS TERMS AND CONDITIONS

The following document details the terms and conditions of Nissan of Boerne One-To-One Rewards Program. Nissan of Boerne One To One Rewards Program members will receive rewards points on purchases of parts, accessories and service purchased at our dealership. We are a full-service maintenance and repair center. As an authorized Nissan Dealer our customers are assured of the availability of Genuine Nissan Parts for all vehicle maintenance and repair needs.

PROGRAM OVERVIEW

The Nissan of Boerne One To One Rewards Program is a loyalty program sponsored by Nissan of Boerne that allows preferred customers to earn rewards points toward future service, parts and accessory purchases. Reward points acquisitions include new and used vehicle purchases, service labor and parts/accessories purchases from Nissan of Boerne, with a maximum of $300 in any one transaction. All earned rewards points may ONLY be used for retail purchases at Nissan of Boerne.

PROGRAM RULES

  1. Rewards points cannot be redeemed for cash.
  2. Any items purchased through the One To One Rewards Program cannot be returned for cash. All returned items' value will be applied to the Rewards Card. No exceptions!
  3. Rewards points earned by Nissan of Boerne expire 24 months from date of issue.
  4. Rewards Plus points earned by shopping online through www.nissanonetoonerewards.com will expire 24 months from date of online purchase.
  5. Rewards points CANNOT be used in conjunction with other specials and coupons.
  6. Your Rewards Card may be used on ANY vehicle in your household.
  7. Rewards points can ONLY be earned on cash purchases. You CANNOT accrue points on warranty, insurance or extended warranty purchases.

EARNING POINTS

  • When you first enroll in the Program, member(s) will receive Nissan of Boerne One To One Rewards online account.
  • There are two types of Rewards points; SALES and SERVICE.

Rewards points can be earned in the following manners:

  1. Sales points - $100 will be instantly rewarded on card upon enrollment to use toward a future vehicle purchase, New or Used (wholesale excluded).
  2. Service points - $10 will be instantly rewarded on card upon enrollment to use in Service. Each service event (parts and labor) earns 5% of total dollars spent (less taxes, freight & shop supplies) towards a future service, parts or an accessory sale.

REDEEMING POINTS

  1. Sales rewards points may ONLY be redeemed towards a qualifying vehicle purchase. *Please see dealer for qualifying vehicles.
  2. Service rewards points may ONLY be redeemed towards a customer-pay service visit or parts/accessories purchase.

GENERAL TERMS & CONDITIONS

Participation in the Program constitutes each Rewards members full and unconditional agreement to these Terms and Conditions. The personal information that is collected from each customer in connection with the Program will be used in accordance with Nissan privacy Policy.

Nissan of Boerne may modify any of the terms and conditions governing the Program-including, but not limited to, the methods which rewards points can be earned, how the Program can be used, the value of the earned points, at any time, without notice, even though these changes may affect the Rewards members ability to use the points that have already been earned. The Program has no pre-determined termination date and may continue until such time that Nissan of Boerne may terminate the program at any time, with no notice given.

Accrued rewards points do not constitute property of a Rewards member and have no value outside the program. Rewards points are credits that Nissan of Boerne may revoke at any time as set forth herein. Rewards points may not be exchanged for cash, assigned, bartered or transferred except as matter or otherwise by operation of law. Each Program member is responsible for ensuring that the information in his/her account is accurate and kept current.

These Terms and Conditions are governed by interpreted under the laws of the State of Texas, US,; as such laws are applied to agreements entered into and to be performed entirely with in Texas by Texas residents. These Terms and Conditions and any documents it incorporates set forth the entire understanding between the parties with respect to the subject matter hereof.

Abuse of the One To One Rewards Program (including failure to follow program policies and procedures, the sale or barter of awards and any misrepresentation of fact relating thereto or other improper conduct, as determined by Nissan of Boerne in its sole judgment, any untoward or harassing behavior with reference to any Nissan of Boerne employee or any refusal to honor Nissan of Boerne employee's instructions) may result in cancellation of the member's account and future disqualification from program participation, forfeiture of all points accrued. Nissan of Boerne reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorney's fees and court costs.

Limitation of Liability governs that each Program member accepts all responsibility for and hereby indemnifies and holds harmless Nissan of Boerne, and each of their related companies (Nissan) and respective officers, directors, employees, shareholders, agent and successors and assigns the Released Parties from and against any claims that may arise from actions taken by such member or for any unauthorized access to Rewards members account from a third party.

Under no circumstances, including but not limited to negligence, shall the Released Parties be liable for any direction, indirect, incidental, special or consequential damages arising out of the program. By participating in the Program, the Member waives any and all rights to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.

If any provision of these Terms and Conditions is found to be invalid or enforceable by court of competent jurisdiction, such provision shall be served from the remainder of these Terms and Conditions, which will otherwise remain in force.
